Nearly 150 contractors, subcontractors and others attended our half-day seminar on House Bill 490, the Fairness in Kentucky Construction Act of 2007 this week. The seminar co-sponsored by Stites & Harbison and members of the Kentucky Construction Coalition drew a near capacity crowd to the Executive Inn West in Louisville and provided an extensive review of the new legislation.

Following a brief video review (42 MB) of the passage of HB-490, lobbyist Judy Taylor explained to the audience from an insider’s perspective how difficult but ultimately satisfying it was to pass the legislation during the brief 30-legislative day session.
The landmark legislation, the first in the nation to apply to both public and private construction contracts is designed to ensure prompt payment, the release of retainage and prohibiting no damage for delay clauses. MORE »
