Past Successes and Future Opportunities
In 2009, after three years of intense lobbying efforts, the AGC of Kentucky — along with more than 40 other small business-related associations known as the Kentucky Small Business Caucus — helped pass legislation creating a $3 million tax credit program for any qualifying construction company or other small business with 50 or fewer employees. The maximum credit that a small business may be eligible to apply for and receive in any given tax year is $25,000. To qualify for the program, companies must invest at least $5,000 in qualifying equipment or technology and create one new full-time hire for one year. We are working with the Kentucky Cabinet for Economic Development’s Small Business Services Division, which will soon begin accepting applications for tax year 2011.
In 2008, we fought to ensure that AGC of Kentucky was represented on the High Performance Building Advisory Council and fought to defeat efforts to remove "exclusive remedy" from the workers’ compensation system, which could lead to more unnecessary litigation in the court systems.
In 2007, AGC of Kentucky and other members of the Kentucky Construction industry sought to pass important legislation dealing with construction contracts, which ultimately became HB-490, The Kentucky Fairness in Construction Act of 2007. A unique coalition of union and open shop contractors and subcontractors formed the Kentucky Construction Coalition, and by the end of the 30-day legislative session and despite strong opposition, we saw passage of the bill, which ensures prompt payment and release of retainage and prohibits "no damage for delay" for both public and private construction projects. The successful passage of this landmark bill firmly placed AGC of Kentucky's Legislative Network as the industry leader among construction associations in the state.
